THELMA in the ICON-S Annual Conference, University College Dublin

 


Another edition of the International Society of Public Law (ICON-S) annual conference took place in Dublin from June 29 to July 1.

As part of the panel chaired by Ruth Alice Houghton and alongside the work of the Feminist Constitutionalism Interest Group, led by Melina Fachin, it was presented the paper "From Datafication to the Courtroom: Judicial Dilemmas in Femtech‑Related Reproductive Rights Violations".

In this paper, we explore legal aspects of the Flo Health case, in which the company shared users' data with third parties without proper consent between 2016 and 2019. The case was initially brought by the U.S. Federal Trade Commission (FTC) and is currently the subject of litigation in courts across the United States, Canada, and Portugal regarding potential violations of users' rights.

These legal proceedings fall within the scope of THELMA’s interests, as they represent the first instances of litigation involving the Femtech sector.
